Terms and Conditions

When you are ready to book a villa or apartment, an agent will send you a Rental Agreement soliciting the 30% deposit on the vacation rental booked with Smaart Vacation N.V. This Rental Agreement is approved and completed when the deposit for the rental has been received by Smaart Vacation; it declares the terms and conditions about the vacation rental between the “Guest” and Smaart Vacation.The payment confirms the acknowledgement and agreement to these terms and conditions explicated below. Call an agent if you need more information or clarification before sending the deposit.

Confirmation of Reservation
When the 30% deposit has been received by Smaart Vacation, the reservation is confirmed. If the guests decide to book the vacation rental with a credit card, it has to be valid at least 60 days after the departure date.

Reservation Restrictions
The guest needs to be over 18 years and also check-in and check out. The guest recognizes he/she will be part of the occupants for the entire rental period and will not sublease the property or a portion. The guests will respect the number of persons written in the contract and are restrained to the maximum occupancy designated for the vacation rental. In case of additional persons, an excess persons fees will be assigned or the guests will evacuate the property with no possible refund. The guest acknowledges that the vacation rental will not be used for any illicit purposes.

Guests are not allowed to bring any prohibited substances (drugs), inflammable liquid, or others articles that could be dangerous.

Payment & Cancellation Policies

Thirty percent of the total amount is due to Smaart Vacation within 7 days of the Rental Agreement sent to confirm the booking. After this date, the booking will be automatically cancelled without notice. Guests will pay the balance due of rent 45 days prior to the check in and some villas/condos accept payment in cash on check-in. Different methods of payment can be used: wire transfer, certified check, or by Credit card (Visa/Mastercard). Smaart Vacation only accept one credit card per booking. 8% bank fees will be added for credit card payment.

All modifications (dates change, number of persons or cancellation) have to be done in writing by email.

-If the cancellation is made 90 days prior to arrival date, 100 per cent of the deposit will be refunded to you

-If the cancellation is made after the 90 days, the deposit is non refundable.

-If the cancellation is made after the 45 days, the total amount is charged on the credit card

In certain cases, owners accept to use that deposit to reserve the vacation rental at a later date without penalty.

Smaart Vacation highly suggests to take a travel insurance.

Late arrivals (days), No show, a decrease in party number, and in advance departures after the check in are non-refundable. Total amount of the rental will be charged on the credit card. Any guests who leave the vacation rental without advising Smaart Vacation will not be compensated. In case of discomfort, or important disturbance, call immediately an agent to see if a relocation or arrangement is possible.

Damage Deposits

Credit card information will be provided to an agent on check in time. This credit card will be used in case of damage, lost items, international calls made from the condo/villa. Each condo/villa has at least 2 set of linens by bed, 2 set of towels per person, 1 beach towel per person. The guests will be charged in case of Smaart Vacation has to replaced them. This is not allowed to open locked closets at the owner’s usage. The main renter will be held responsible for the whole party and ensure that the party respects the rules of the vacation rental.

Liability

Smaart vacation is an intermediary between the owner and the renter and does not assume liability for accidents, injury, burglary, robbery, death that may occur by any reason during transportation to the villa/condo or during their stay in the vacation rental. Guest must follow the safety instruction given by the agent during check in.

Pets

Pets are not allowed on the property except with a permission from Smaart Vacation, given before guests’ arrival.

Maintenance problem

All the condos and villas are checked before guests’arrival for a perfect stay. In case of an unexpected problem, call an agent immediately to notify the problem. We will work on the problem  to fix it as soon as possible. However, St Maarten/St.Martin is a small island so be aware that internet service, supply of electricity and water, telephone service are irregular and a brief cut is possible during your stay. No refund or ajustement rate will be accorded for supply of electricity, water, telephone service, internet service, pool filtration, amenities failures (hot tub, steam room, hot tub…), air conditioning, television and cable system, kitchen appliances…We will do our best to respond to your maintenance problem with competent and responsive contractors.

Check-In and Check-Out Times
Guests must free their vacation rental before 12 noon, and check-in time is from 3.00pm. Late check out can be asked one day before by email. The concierge will see if it is possible with the next booking.

Entry into Villa/Condo
In case of emergency, Smaart Vacation may enter the vacation rental if necessary without notice.

Substitution
Smaart Vacation may replace comparable or better accommodations without compensation, in the case the vacation rental has been sold, is of order, has been accidentaly double-booked. If similar rentals are not available, the guest will receive a complete refund including Government Tax paid for the reserved villa/condo.

Villa/Condo Keys
Smaart Vacation will charge the guest $50 for missing or incomplete set of keys, gate remote controls will be charged $80. Thee keys will be collected by an agent during check-out time.

Capacity of Villa/Condo

The total number of the group staying in the villa/condo must be conform to the capacity of the vacation rental. A bedroom accepts 2 persons. If additional persons are present in the villa/condo, the guests will pay additional fees per extra person. Babies under 2 years old, sleeping in a crib, are not counted in the total group number.

Parties

Guests must respect the local rules which ask the residents not to make too much noise after 10pm. No parties, wedding or ceremony are allowed in the villa/condo without Smaart vacation’s permission.

Rates

Rates may vary anytime on the website and may be subject to increase or decrease during the year. The prices written on your rental agreement are binding and no compensation will be done.

Arrival on Island

One week before your arrival, guests will receive an email with information and also to remind them to send the flight information, time of landing, car rental company and the cell phone used on the island. The concierge will let the guest know the meeting point (at the car rental or directly at the villa/condo).

Arrival at the Villa/Condo

The concierge will give the guest the keys, a briefing concerning rules and security and a walk-through of the property explaining some devices. Do not hesitate to ask your questions. He will also show you a specialized guide of the island with activities, restaurants, shopping, hiking information…The guests will provide the agent with his/her check out time.

Housekeeping Service

Cleaning is included during your stay. Time of passage may vary depending on villas/condos.  There is no cleaning on Sunday. Additional cleaning hours can be purchased for $10/hour. The maid will make the bed, clean the kitchen, the bathrooms, change the towels and linens. The maid is not on charge of the personal laundry but you can have an arrangement with her.
Welcome Basket

Guests will find a complimentary welcome basket in the fridge of your villa/Condo. Waters, 1 local rhum, and soft drinks. Concierge can also pre-stock your vacation rental. The cost is $60 for shopping and delivering. Cost of the food is not included.

Concierge Services

The concierge will be dedicated to your needs. If you have any questions concerning activities, things to do, private chef, massage, events and nightlife do not hesitate to contact our concierge.

Baby Crib
We have baby crib available for rent ($50 usd/week).

Swimming Pools

All the swimming pools are protected with an alarm and the guests have the responsability to switch them on during their stay.
